Contracts Supporting The Foundation

Contracts Supporting Charitable Projects

As a fiscal sponsor, the Apereo Foundation, enters into and manages contracts on behalf of Apereo projects and communities (i.e., charitable projects). Charitable Projects (i.e., Apereo projects and communities) are not capable of entering into contracts themselves, as they are not recognized as legal entities.

Roles and Responsibilities

A contract must be in place between Apereo and all third parties before any work may begin with an Apereo charitable project.

Charitable Projects

Because charitable projects (i.e., projects or communities supported by Apereo's fiscal sponsorship) are not legal entities in and of themselves, they may not enter into legal agreements such as contracts. Apereo projects seeking services, engaging a consultant, renting space, or undertaking any other activity requiring an agreement, must have a contract in place between the Apereo Foundation and the third party before work can begin or any payments are made.

While the contract/agreement will be between the Foundation and the third party, the charitable project has complete oversight in defining the terms of the contract, e.g., statement of work,  rate and fees, timelines and schedules, deliverables, roles and responsibilities, etc.
